"No child ever kills a parent for something so base as pure greed (which, of course was the prosecutions simplistic theory, that demonized Erik and Lyle Menendez as part of the script that they hoped would end in death). Always something terrible has happened to ensure that this primal bond is not just torn or strained as it is with many families but blasted apart"

Before the trial, Lyle served as a jail trustee, delivering meals and distributing mail to fellow prisoners. He preferred it to being locked in a cell all day. At one point, Lyle Menendez became a tourist attraction, a popular diversion when visitors would tour the jail.
βThey used to bring me out as a spokesperson,β he says. βThey would bring me around the corner and sort of parade me like the Elephant Man or something. People were shocked. I donβt think they actually expected to meet me. The kids would all be excited, and I actually didnβt mind it.β
βThey would recognize me immediately and I wouldnβt be handcuffed or anything,β he said. βI would just stand there with a few deputies and we would joke around. They allowed them to ask me questions and then they would say, βWhatβs it like? It must be a big switch for you, being in jail. How do they treat you in here?β Obviously, I couldnβt say that they beat me down every day or something.β

"We alone know the truth. We alone know the secrets of our family's past. I do not look forward to broadcasting them around the country. I pray that it never has to happen. If it were not for you I doubt I would even try for manslaughter. I would rather try and escape or die. I struggle with my belief that men take responsibility for their actions, pleading abuse is not taking responsibility. We alone can get ourselves through this life after all that has happened.
I think if Dad could give us one piece of advice as we left the house that night in August, it would be never to abandon each other no matter the circumstance. Never turn against each other no matter the pressure. What we did in August was a mistake from what I can tell and I don't know what to do about it. What can I do? Nothing I guess. I honestly do not believe I am far away from packing my bags and calling it a life. I do not see things in terms of manslaughter and life terms. I only see win, lose, honor, and dishonor. I refuse to give up for Dad's sake. He is watching and I will not disappoint him a second time, or Mom by giving up and having their deaths be in vain." β Lyle Menendez.
Lyle Menendez ca. 1970.
βDid he talk to Lyle when he was a small child as if he was a small child?β
βNo, he talked to him as an adult.β
βAnd did that go on until Lyle was an adult?β
βOf course.β
βDo you recall when he was a little toddler?
βYes I do.β
βDo you recall how Kitty treated Lyle when he was very young?
βShe did not like Lyle, she seemed to resent him.β
βDid she pay much attention to him?β
βNo, she did not.β
βDid she pick him up and hug him and kiss him and coo and fondle and cuddle and do any of those things?β
βNo.β
βDid you ever see a situation, particularly during that weekβs visit when Lyle would express hunger? That he was hungry?β
βWell, he would fetch for himself. He would go get on top of whatever was needed and just try to reach whatever he wanted to eat.β
βOkay, and did you comment on this to your sister in law?β
βYes, I tried to grab whatever he was trying to grab at one time and Kitty told me βMarta leave him alone! He can do it for himself, heβs used to it.β
βAnd heβs four and a half, going on five?β
βYeah.β
βHad you seen anything like that even earlier?β
βYes.β
βAt about what age? What of Lyleβs age?β
βTwo, two and a half.β
βAnd howβd it come up at two or two and a half?β
βLyle would just go and climb a chair and get on top of the counter and get his cereal and rip off the box and pour it out and it was just a disaster.β
βAt that stage before the child went and climbed and tried to do these things did he express hunger? Did she in other words, did you ever hear her tell him as a little guy go get it yourself or feed yourself?β
βNo, I did not. He seemed to know that, he seemed to know that he would just go and get it himself.β
βWhen you observed Lyle at that young age climbing counters and reaching inside cereal boxes was your sister in law present?β
βYes.β
βDid she make a move to grab the baby so he doesnβt fall off the counter?β
βNo.β
βNothing?β
βNo.β
βDid you make a move?β
βYes I did.β
βAnd thatβs when she stopped you and said he can fend for himself?β
βThatβs correct.β

"I have had a fantasy since the day I started representing Erik, if people were to ask me after three and half years of thinking about him and this case every single day somehow or another, even on vacation. What is it I want out of it, my answer is not necessarily a legal one. Thereβs only one thing I could actually focus on that I wanted. I want to see him walk down street, not in chains, not in shackles, not with a deputy sheriff standing next to him. Now to fulfil my dream and my fantasy, youβd have to come back with a verdict of not guilty and if you donβt feel you can do that based on the instructions that youβre getting. I would ask that you come back with a verdict of involuntary manslaughter because I believe thatβs what the evidence shows."

Lyle Menendez in 1978.
βDid the medical history also show a history in August of 1976 of a speech articulation disorder and below grade level school performance?β
βYes.β
βDid it also include an entry on August 4th, 1978 that he grinds his teeth?β
βI remember the teeth grinding.β
βWas there also a report on October 19th, 1976 of stomach pains?β
βYes.β
βOn March 7th, 1977 of global headaches?β
βYes.β
βWas there also various reports from 1971 to 1989 of complaints of headaches?β
βYes.β
βWould any doctor looking at that full range of symptoms been alerted to the possibility of sexual abuse?β
βIβm not aware of any physicians in the 1970βs that would have madeβ¦ would have even thought of the diagnosis of child sexual abuse. The same symptom constellation today probably a small percentage of physicians would make that connection, even though many of those things are symptoms that are seen in children that are sexually abused over a long period of time I donβt believe that the average physician, even the average pediatrician would make that connection.β
βEven today with that advanced state of knowledge that there is with the examination of child sexual assault victims do physicians miss possibilities that a child has been sexually abused?β
βCertainly.β
βBack when some of these examinations were made that is the examinations made by physicians who examined Lyle Menendez for instance in 1971 when he was three years old or 1974 when he was six years old, was the state of knowledge such at that point that it was even a higher likelihood that a physician may have missed indications of child abuse?β
βAbsolutely.β
