I know a lot of people have already said this, but Luigi is currently considered legally innocent... I was on a jury for a criminal trial a few years ago, and they specifically told us that the only person in the courtroom who is considered legally innocent is the defendant. Luigi is innocent. He is legally innocent at this very moment. He has not been proven guilty beyond a reasonable doubt in a court of law (yet), and yet the media and law enforcement and politicians are all acting like he has been found guilty already. There's no way he is going to have a fair trial if he continues to be treated like he has already been proven guilty when he is literally legally innocent!!!
